We define a purchase as placing an order with us via phone, email, our website, fax, or any other means not delineated specifically.

All orders will be filled without alteration and we will attempt to meet all of the specific parts of your individual orders to the best of our ability. There are no guarantees that orders will be filled error-free. Once a purchase is entered into our system, we will provide email confirmation of your order. This email confirmation is only intended to provide you with a reference and in no way binds us to sending you the product/s ordered.

We do not guarantee availability. When a product is not in stock, we may contact you and offer a replacement product or a refund of your money. If, after we contact you, we receive no response from you, the order will be cancelled and your money will be refunded.

If you provide us with an incorrect address, we are not responsible for sending products to that incorrect address. Merchandise will only be delivered to the address indicated in the orders that we receive.

You are responsible for inspecting the items we send you immediately. If you receive merchandise that does not accurately meet the description or merchandise that includes defective or missing items contact us immediately. Do not use products that include defective or missing items or that does not meet the correct description before contacting us. We are not responsible for your choice to use any items from orders that were incorrect, defective, missing parts prior to contacting us.

We reserve the right to refuse price match requests for any reason we find to be sensible.

We accept all major credit cards as methods of payment. Until you have paid in full, any goods or products remain our property We reserve the right to attempt recovery of unpaid or outstanding balances that remain unpaid after your purchase.

We will pay postage for defective goods. However, you remain liable for merchandise until we receive your returns.

Terms and Conditions for Contact Lenses and Prescription Eyewear:

Your use of our site constitutes agreement to these terms for prescriptions and prescription purchases.

We define purchasing as placing an order for merchandise with us via phone, email, website, fax, or any other means.

We define prescription purchases as placing orders for products or merchandise prescribed by a licensed optometrist (including but not limited to items like contact lenses or prescription eyewear).

To make prescription purchases, you must have a prescription from a registered optometrist. Your submission of a prescription purchase is your guarantee that you possess a recent written legitimate prescription from a registered optometrist and that your prescription purchase will be used in full accordance with your optometrist’s prescribed regimen.

We always reserve the right to contact your optometrist to verify all of your prescriptions and prescription purchases. We also reserve the right to ask to have copies of your original prescription/s faxed to us at www.ezcontacts.com.

The details of prescriptions for all prescription purchases are included among the details of your prescription purchases. It is your sole responsibility to verify that the product/s match/es your optometrists prescription before purchase and before usage.

In the case that the actual product or merchandise does not match the prescription that you submitted in your order, refrain from using the product or merchandise and contact us immediately.

When you purchase a prescription product from us you must also review and consent to the terms and conditions of the purchase contract.

Exclusions and Limitations:

The information provided through www.ezcontacts.com is on an “as is” basis. To the fullest extent permitted by law, this Company:

  • Excludes all representations and warranties relating to our site and all of its contents or which is or could be provided by its affiliates or any related third parties. Including those in relation to any inaccuracies and/or omissions in the website and/or in the company literature: and
  • Excludes all liability for damages arising out of or in connection with you or anyones use of our site. This exclusion includes without limits, direct loss, loss of business of profits (whether or not the loss of profits was forseeable, arose in the noral course of business, or if you have advised us of the possibility of such loss), damage caused to your computer, computer software, systems, and programs and the data thereon or any other direct or indirect consequential and incidental damages.

EZContacts Shipping Protection Service Contract

1. Program Overview

The EZContacts Shipping Protection program is an optional service contract designed to provide peace of mind for your deliveries. By purchasing this protection at checkout, you ensure an expedited resolution process for covered shipping mishaps.

  • Service Contract: This program is a service contract and shipping guarantee provided directly by EZContacts. It does not constitute an insurance policy and is strictly optional. It is not required to purchase goods from EZContacts.
  • Non-Refundable: All fees paid for this shipping protection are non-refundable and non-transferable once the order has shipped.

2. What is Covered & Coverage Limits

This service contract covers EZContacts products that suffer from the following covered incidents during transit:

  • Lost deliveries
  • Stolen packages
  • Items physically damaged during transit

Coverage Limitations:

  • Maximum Liability: Under no circumstances shall EZContacts’ liability under this program exceed the original purchase price of the covered items or $1,000.00 per order, whichever is less.
  • Claim Limits: Customers are limited to a maximum of two (2) approved claims within any consecutive 12-month period.

3. Claim Review & Exclusions

EZContacts strives to protect our customers, but we do not guarantee the approval of all claims. Every claim is subject to a thorough review process.

EZContacts reserves the right to deny claims or revoke protection in our sole discretion, including but not limited to cases involving:

  • Intentional damage, willful misconduct, or dishonesty.
  • Suspected fraud or claims containing false, incomplete, or misleading information.
  • Customer input errors (e.g., providing an incorrect shipping address at checkout).
  • Violations of the overarching EZContacts Terms of Use.

4. Timelines for Filing a Claim

Strict timelines apply to ensure accurate carrier tracking and prevent fraudulent reporting.

  • Damaged Items: Claims for products that arrive damaged must be reported to EZContacts within 48 hours of the actual delivery date and time recorded by the shipping carrier.
  • Lost or Stolen Packages: Claims must be reported no sooner than 3 days (to account for premature carrier "delivered" scans) and no later than 7 days from the scheduled delivery date or the carrier's marked delivery date.

Note: Claims submitted outside of these required timeframes may be automatically denied by EZContacts.

5. How to File a Claim

To initiate a claim, please contact our Customer Care team:

Required Documentation & Steps:

  • For Damage: You may be required to submit photographic evidence of the damage. EZContacts may also require you to return the damaged goods using a prepaid shipping label we provide. Failure to return the damaged item when requested may result in the denial of your replacement or refund.
  • For Theft: In cases of suspected theft, EZContacts may require a signed affidavit attesting to the theft and/or an official police report filed with your local authorities.

6. Resolution Process

Once a claim is reviewed and approved, EZContacts will typically process the resolution within 7 to 10 business days.

  • Replacements: Our primary remedy is to ship a replacement of the exact same model. If the exact model, color, or style is out of stock or unavailable, you will have the option to select an alternative product of equal or lesser value.
  • Refunds: If a replacement cannot be provided, or if you prefer a refund for an approved claim, EZContacts will issue a refund for the original purchase price of the items (excluding the shipping protection fee). Refunds are processed back to the original payment method only.
  • Final Settlement: The issuance of a replacement or refund constitutes full and final settlement of your claim. By accepting the resolution, you release and discharge EZContacts from any further claims or liability regarding that specific order.

7. Dispute Resolution & Communications

By opting into this program, you consent to receive communications regarding your claim and coverage via electronic means or phone.

In the event of a dispute regarding these Shipping Protection terms or a claim decision, the dispute shall be resolved exclusively in accordance with the mandatory arbitration and dispute resolution provisions detailed in the main EZContacts Terms of Use.
